Subject matter and scope of the Terms of Use

Subject matter

These Terms of Use govern the commencement, content and termination of your membership of Second Home, represented by the game management.

Scope of application

These terms of use apply to all services offered (hereinafter referred to as ‘Second Home’):

• portal server (https://second-home.org)
• all game servers
• Discord server

Participation

Prerequisites

In order to participate in Second Home, it is necessary to agree to these terms of use, if necessary through your legal representative. This is done at the time of registration.

Start and duration of membership

Membership begins when you join Second Home (e.g. registering a user account, joining the Discord server). Membership is concluded for an indefinite period.

Cancellation by the player

Membership can be terminated at any time by deleting the user account.

Termination by the game management

Membership can be cancelled at any time by the game management within 2 weeks by email. In the event of violations of these terms of use or the rules of the game, the game management may immediately delete or block user accounts. There is no legal entitlement to participate in Second Home, in particular due to the free nature of Second Home.

General terms and conditions of membership

1. Membership is only possible for individual, natural persons

2. Your user account must contain an email address registered to you
.
3. You may only have one user account at any one time
.
4. The transfer of user accounts is only possible with the consent of the game management.
5. You are not entitled to a specific user name. Your username can be changed by the game management at any time.

General obligations of users

1. The data provided as part of your registration, in particular the email address, must be kept up to date.
2. Upon request, the accuracy of your data must be confirmed
.
3. Your access data must be kept secret and may not be passed on to third parties
.
4. The use of other people's user accounts is prohibited
.
5. The use of Second Home for advertising or commercial purposes requires the written consent of the game management.
6. Use with anonymisation services that disguise your IP address is not permitted
.

Services

1. The game management is authorised to interrupt the services of Second Home at any time for technical reasons or for maintenance work without prior notice
.
2. The game management is authorised to discontinue the services of Second Home in whole or in part at any time.

Special provisions for the use of Second Home

1. Second Home may only be used in the latest version. You are responsible for the software and hardware you use.
2. No data may be sent via Second Home that has a negative impact on the recipient's hardware or software.
3. Measures that disrupt the functionality or gameplay are prohibited

4. Measures that lead to an excessive load on technical capacities are prohibited
.
5. Measures to suppress advertising are prohibited
.
6. The use of bots/tools/scripts or programmes to take advantage of you or others is prohibited.
7. The exploitation of errors (‘bugusing’) is prohibited.
8. All user accounts, including the associated resources, ships, etc. are virtual items in the game. These items are only made available to you. You do not acquire any ownership or other rights to them; all rights remain with the game management. There is no transfer of utilisation or other rights to you.
9. The sale or auction of virtual items or user accounts for real money is not permitted.
10. In-game trading is permitted if and to the extent that the rules allow it.

Content by users

1. Each user is responsible for the content he/she creates. This includes, among other things:
   • Messages
   • contributions
   • chosen names
   • Images
   • Links
   • etc.
   The user shall indemnify Second Home against third-party claims based on a culpable breach of his/her obligations.
2. You undertake to use an appropriate choice of words.
3. The publication of content that
   • violate applicable law,
   • violate the rights of third parties,
   • is obscene, racist, offensive or glorifies violence,
   • have a sexual reference,
   • give the impression of being provided or supported by Second Home,
   • are of a commercial, political or religious nature,
   • are likely to demean any person,
   is prohibited.
4. The game management has the right to remove content that contravenes these rules.

Consequences of a breach of duty

1. The game management reserves the right to delete or block user content or the user account itself.
3. After deletion of the user account by the game management, renewed participation in Second Home requires the explicit consent of the game management.

Limitation of liability

1. Costs incurred for the use of Second Home will not be reimbursed
.
2. Second Home assumes no liability for server failures, programming errors, etc. If a player suffers any disadvantages due to server failures, programming errors, etc., the player has no claim to restoration of the status prevailing before the event or to compensation.
3. Second Home accepts no liability for damages caused by the use of Second Home. Liability is excluded with the exception of damages caused by intent and gross negligence as well as all damages to life and health. In this respect, it is expressly pointed out that excessive participation in computer games sometimes harbours considerable health risks.

Change to the terms of use

1. The game management is authorised to change or amend these terms of use at any time. You will be informed of any changes/additions to the terms of use at least two weeks before they come into force via the start page or by email or in-game.
2. If you do not agree with the changes/additions, you have the right to terminate your membership by deleting your user account.
3. The new terms of use are deemed to have been accepted if you log into Second Home after they come into force.

Final provisions

1. Choice of law & place of jurisdiction

The law of the Federal Republic of Germany shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.

2. Severability clause

In the event that individual provisions of these Terms of Use are invalid, the remaining provisions shall remain in force. The invalid provision shall be replaced by the statutory provision.

3. Translation

These terms of use have been translated from German. In the event of any discrepancy as to the content of the provisions, the German version of the provision shall prevail.
